Can I Discharge Taxes and Student Loan Debt?

Bankruptcy can do a lot for you, but there are some things that even bankruptcy may not change. In most cases, you cannot discharge recently-incurred income tax debts.  Also, if you wish to retain your house (or other real estate), you cannot discharge any accompanying property tax debts.

Student loan debts are generally not dischargeable. Alimony and child support debts are never dischargeable in bankruptcy. In these situations, it is important to have the advice of an experienced attorney in order to determine how to address your unique financial situation.

When you file for Chapter 7 bankruptcy, your unsecured debts (such as credit card debt and medical debt) may be eliminated. When you file for Chapter 13 bankruptcy, your debts will be reorganized into a more manageable repayment plan.

With a Chapter 7 or Chapter 13 bankruptcy case, you may be able to gain the breathing room you need to start addressing debts than cannot be discharged. With a little time and a sound repayment plan, you may be better able to address your back taxes or student loan debts.
