The Benefits of Filing Chapter 7 Bankruptcy
Chapter 7 bankruptcy (sometimes called a liquidation bankruptcy) cancels (or "discharges") your unsecured debt. Unsecured debt includes credit card debt and medical debt. This is debt that you do not have to pay back — ever. Unfortunately, student loan debt and some taxes may not be dischargeable. What Property Can I Keep?
Most people want to know what property they can keep if they file for bankruptcy. The Bankruptcy Code generally allows you to keep your home and your automobile, most household furnishings, and other basic items. These items are called "exempt property," and the state and federal laws that specify what property is exempt are called "exemption statutes."
In the overwhelming majority of bankruptcies filed by individuals, all (or virtually all) your property is "exempt," and is yours to keep.
If I Earn Too Much can I Qualify for Chapter 7?
In order to qualify for a Chapter 7 bankruptcy, your average income is calculated, and you may have to pass a "means test," that essentially measures your ability to pay your existing debts. If your income is too high, you may not qualify for a Chapter 7. But you may still have the option of filing a Chapter 13 Bankruptcy, which involves a reorganization and partial repayment of your unsecured debts.
